 UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, OR OTHERWISE, SHALL SUBCOOL AIR AND HEAT ITS EMPLOYEES OR AGENTS BE RESPONSIBLE OR LIABLE FOR ANY CONSEQUENTIAL DAMAGES, DIRECT OR INDIRECT INCLUDING BUT NOT LIMITED TO, DATA DAMAGE, PROFIT LOSS, LOST DATA, LOSS OF OPERATING TIME OR LOSS PRODUCTS RESULTING FROM THE BREAKDOWN OR FAILURE OF ANY EQUIPMENT OR FROM DELAYS ANY SERVICE. UNDER NO CIRCUMSTANCES SHALL SUBCOOL AIR AND HEAT BE LIABLE FOR ANY LOSS, COST, OR DAMAGE ARISING FROM ANY SOURCE, INCLUDING NEGLIGENCE, IN EXCESS OF THE PRICE PAID BY THE CUSTOMER FOR THE SERVICE.
